With this agreement, Lafayette Pool and Spa, LLC is only providing a service. Lafayette Pool and Spa, LLC does not carry any warranty against freeze damage or other damage to the pool, pool equipment, pool accessories, underground lines, water fill lines or water clarity. Any warranties on the products sold hereby are those made by the manufacturer. Lafayette Pool and Spa, LLC hereby expressly disclaims all warranties, either express or implied, including any implied warranty of merchantability or fitness for a particular purpose, and Lafayette Pool & Spa, LLC neither assumes nor authorizes any other person to assume for it any liability in connection with the sale of products or the providing of any services. All warranties, if any, by a manufacturer or supplier other than Lafayette Pool and Spa, LLC are theirs, not Lafayette Pool and Spa, LLC’s, and only such manufacturer or other supplier shall be liable for performance under such warranties, unless Lafayette Pool and Spa, LLC furnishes you with a separate written warranty or service contract made by Lafayette Pool and Spa, LLC on its own behalf, Lafayette Pool and Spa, LLC hereby disclaims all warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose: (a) on all goods and services sold by Lafayette Pool & Spa, LLC, and (b) on all used equipment or goods which are hereby sold “as is—not expressly warranted or guaranteed.”
This agreement does not and shall not include maintenance repairs made to pool or pools filtration system.
It is agreed that in the event of breach of contract or of any warranty, the liability of Lafayette Pool and Spa, LLC shall be limited to the repayment to you of the price paid by you for the services provided and upon the return to Lafayette Pool and Spa, LLC of the nonconforming goods. Lafayette Pool and Spa, LLC shall not be liable for any other damages, whether direct or consequential.
Cancellation is subject to a $50 cancellation fee.
